Sweepstakes Platform Terms and Conditions

1. Introduction

Welcome to PGS Amusements, LLC ("PGS Amusements, LLC", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your participation in our sweepstakes gaming platform ("Platform"). By accessing or using the Platform, you acknowledge that you have read, understood, and agreed to these Terms.

2. Eligibility

2.1 Age Requirement

Participation in our sweepstakes games is restricted to individuals who are at least 18 years of age or the legal age in their jurisdiction, whichever is higher. By signing up, you confirm that you meet this requirement.

• If you attempt to register and are under 18 years of age, you will receive the following message: "You are under 18 years of age and unable to participate in the sweepstakes. Please review our Terms and Conditions." You may not proceed with account creation.

2.2 State Restrictions

Sweepstakes participation is not permitted in certain U.S. states where sweepstakes gaming is restricted. If you attempt to register from the states of Michigan, Nevada, Idaho, or Washington, you will receive the following message:

"You are ineligible to play in this State. Please review our Terms and Conditions." Your registration will not be completed.

We use geo-location and other verification tools to enforce these restrictions. Attempting to circumvent these restrictions through the use of VPNs or other technology is strictly prohibited and may result in account termination.

3. Know Your Customer (KYC) Verification

To maintain a secure gaming environment and comply with legal and regulatory requirements, we have implemented a Know Your Customer (KYC) verification process.

3.1 When KYC Verification is Required

• KYC verification is not required to participate in sweepstakes games.

• However, before any prize redemption, you must successfully complete the KYC process.

• Completing KYC early is recommended to avoid delays in prize redemption.

3.2 KYC Verification Process

To verify your identity, you must submit the following:

1. Proof of Identity: A valid, government-issued photo ID (e.g., driver’s license, passport, or state identification card).

2. Proof of Residential Address: A document issued within the last six months, such as a utility bill, bank statement, or government correspondence, displaying your name and current address.

3. Selfie Photo: A clear, recent selfie to confirm your identity and match the submitted ID.

Failure to complete KYC verification will result in an inability to redeem any winnings. If discrepancies or fraudulent information are detected, we reserve the right to suspend or terminate accounts.

4. No Purchase Necessary Clause

• No purchase, payment, or consideration is necessary to enter or win.

• Participants can enter for free through an alternative method of entry (AMOE), such as a mail-in entry.

• Details on the AMOE will be provided for each sweepstakes.

5. Sweepstakes Duration & Entry Periods

• The start and end dates/times of each sweepstakes will be clearly stated.

• Time zones governing entry deadlines will be specified (e.g., Eastern Standard Time).

• If applicable, multiple entry periods will be defined.

6. How to Enter

• Outline the methods of entry (e.g., playing a game, social media entry, mail-in entry).

• Define how entries are counted and any limitations on entries per person/household.

7. Selection of Winners & Odds

• Winners will be selected through a random process.

• The odds of winning depend on the number of eligible entries received.

• Notification procedures and response deadlines will be provided.

8. Prize Details & Restrictions

• Full descriptions of each prize and estimated retail value (ARV) will be disclosed.

• Any restrictions (e.g., non-transferable, expiration dates) will be stated.

9. Publicity Release & Use of Winner’s Name

• Winners may be required to consent to their name and likeness being used for promotional purposes.

• An opt-in/opt-out clause will be included.

10. Taxes & Legal Responsibilities

• Winners are responsible for all federal, state, and local taxes.

• If the prize value exceeds $600, a 1099-MISC tax form will be issued.

11. Liability Release

• We are not responsible for technical failures, lost entries, fraud, or force majeure events.

• A release of liability may be required before prize redemption.

12. Disqualification Rules

• Actions that constitute disqualification include:

  • Providing false information

  • Using automated entry methods

  • Multiple accounts for bonus abuse

  • Attempting to manipulate the system

13. Privacy Policy & Data Use

• Personal data collection, storage, and use will be explained.

• A link to our Privacy Policy will be provided.

• Users may request data removal.

14. Dispute Resolution & Arbitration Clause

• All disputes must be resolved through arbitration.

• A class-action waiver applies.

• The governing jurisdiction will be specified.

15. Force Majeure Clause

• If events beyond our control impact the sweepstakes (e.g., natural disasters, legal changes), we reserve the right to modify or cancel the sweepstakes.

16. Sponsor Information

• The full legal name and address of the sweepstakes sponsor will be disclosed.

17. Cancellation or Modification Clause

• We reserve the right to cancel, suspend, or modify the sweepstakes at any time.

• Conditions under which cancellation may occur will be detailed.
